With little warning, the Senate Democrats have announced that they will be voting on an amendment that would prohibit you from increasing your price after July 1st unless your costs go up.
The Attorney General (AG) will be able to investigate you (and all businesses in the state) based on his belief that your prices are “grossly disproportionate” compared to the price previously charged your customers. This includes business-to-business transactions.
This language would apply to all sellers of goods and services (ie. wholesalers, retailers, service, c-store, etc). Every CEMA member (including associates) will be impacted by these pricing restrictions.
It also repeals the trigger as to when the gouging laws can be applied. Current law requires the Governor or President of the United States to declare an emergency to trigger this law which gives business notice when the law applies. That would now go away exposing you to enforcement anytime you raise your prices.
If you are a member of your local chamber of commerce or other business organization we encourage you to alert them to this bill and ask them to oppose it.
Please contact your local legislators and urge them to vote against this proposal by copyINH and paste to your brower.
A vote in the Senate may come as early as today.
